Phusion Projects Reaches Agreement with FTC

 

Makers of Four Loko to Introduce Can Capable of Resealing, Enhance Labeling

CHICAGO, IL – February 12, 2013Phusion Projects (“Phusion”) today announced that it has reached an agreement with the U.S. Federal Trade Commission (“FTC”) regarding its flavored malt beverages, such as Four Loko. The Consent Order (“Order”), which was approved by the Commission, resolves issues raised by the FTC regarding some of Phusion’s product packaging and marketing practices.

“While we do not agree with the FTC’s allegations regarding these issues, we consider this agreement a practical way to move forward,” said Jaisen Freeman, one of the co-founders of Phusion Projects. “We share a common interest with the FTC in providing consumers with information and packaging options to help them make informed, responsible decisions.”

Under the Order, Phusion will provide consumers with the capability to reseal the containers for some of its flavored malt beverage products, such as its current 23.5-ounce, 12 percent and 8 percent alcohol by volume Four Loko products. Also, if approved by the Alcohol and Tobacco Tax and Trade Bureau, the Order requires the inclusion of additional alcohol content information on the labels of certain of Phusion’s flavored malt beverage products.
